Family members of missing persons can receive a survivor’s pension. How to get a pension for the loss of a breadwinner was told to relatives in the Ministry of Social Affairs

When a person receives the status of “missing”
A person receives the status of a missing person from the date of submission to the territorial body of the National Police of an application for the search for a missing person . The legal status of a missing person is defined in the Law of Ukraine “On the Legal Status of Missing Persons”. Such an application can be submitted by a relative, a representative of a military formation, a state authority, a local government, an association of citizens or anyone who has become aware of the disappearance of a person.

When can relatives receive survivor’s pensions?
A month from the date of entering information about the disappearance of a person into the Unified Register of Pre-trial Investigations , family members of such people can receive pensions.
Which of the relatives of the missing person is entitled to a pension in the event of loss of a breadwinner?
- Children under 18.
- Children from 18 to 23 years old, studying in full-time education, until graduation.
- Children of the missing person who are orphans, up to 23 years old, regardless of the fact of education.
- Husband or wife, parents if they are persons with disabilities or have reached retirement age.
- Husband or wife, and in their absence, one of the parents or brother or sister, grandfather or grandmother of the breadwinner, regardless of age and ability to work, if they do not work and take care of the child of the breadwinner until he reaches 8 years of age.
- The parents and the husband or wife of the missing person, who were not supported by the missing person, are entitled to a survivor’s pension if, as a result of such disappearance, they have lost their source of livelihood.
. What are the features of the payment of a survivor’s pension to the relatives of the missing
- The pension is paid for the entire time that the missing person retains this status.
- The pension for the loss of a breadwinner to disabled relatives who were in the care of the missing is assigned regardless of the duration of the insurance period of the person who disappeared.
- If a note is made in the Unified Register of Pre-trial Investigations about the location, place of burial or location of the remains of the missing person, then the corresponding changes are made to the period for assigning a pension, taking into account the established circumstances.
- If a person has the status of a missing person, this does not deprive his relatives or other persons of the right to apply to the court with an application to declare such a person dead in the manner prescribed by law.
