With regard to military personnel who are not physically in Ukraine, it is necessary to move to the correspondence process. However, under the current government, the Russian Federation will not extradite anyone.
The question of how the Russian military will be held accountable if they are in Russia is an eternal one. If war criminals – war prisoners – are here, it is possible to start trials in Ukraine.
This was announced at the conference on May 3 by the Prosecutor General of Ukraine Irina Venediktova.
According to her, now the Office of the Prosecutor General is carefully working to ensure that in relation to prisoners of war it is very professional to prove, according to the standards of international humanitarian law, that they are war criminals.
Venediktova recalled that not all who came to fight are war criminals, but only those who rape, kill civilians, torture, loot.
“If they are here, we begin to judge them physically. I really hope that we will soon go to court with war criminals under Article 438 (war crime),” she said.
According to the Prosecutor General, if there are no military personnel in Ukraine, it is necessary to move to the correspondence process.
“We are also collecting all the ownership and admissibility of evidence… The prosecutor of the International Criminal Court will go through the process in the same way. The question is: will the Russian Federation extradite anyone. With this government, they will not. we are ready, we are open and do not hide anything. We understand who committed these atrocities and we are ready to investigate,” she concluded.
Earlier, Venediktova said that the Russian occupiers will be judged not only according to international law, they will also be held accountable for their atrocities in Ukraine. Also, a special military tribunal can be created for a specific crime.
