The preferential system with a tax of 2% is likely to be abolished soon

At the beginning of the full-scale Russian aggression, the authorities went to meet business and introduced several benefits in the field of taxation. In particular, in order to facilitate the survival of business during the war, FOPs were given the opportunity not to pay VAT, and a preferential rate of payment of a single tax of 2% of the received income was introduced for companies and FOPs. And although it was planned that the benefits would operate until the end of martial law, and it was recently extended, the Verkhovna Rada is already planning to cancel the preferential taxation regime at the rate of 2% of turnover.

According to the State Tax Service, by November, 50,800 Ukrainian companies switched to the preferential regime, which is only 3.6% of the total number of legal entities in Ukraine. In April-October, these companies paid more than UAH 4.6 billion to the budget. tax At the same time, this preferential regime turned out to be more popular among FOPs. According to the same tax service, the right to reduce the single tax from 5% to 2% was used by 252,000 sole traders (14.8% of the total number) – 5 times more than legal entities. The total amount of the single tax paid by the FOP at a preferential rate of 2% was almost UAH 3.9 billion.

So far, there are no exact calculations as to how the benefit with the payment of a single tax at the rate of 2% affected the state and the economy in general. However, Deputy Chairman of the VRU Tax Committee, Yaroslav Zheleznyak, believes that due to the introduction of this rule, the state will not receive 500-700 million hryvnias every month. At the same time, about 200 million hryvnias from this amount are budget losses related to the use of the benefit by the gambling business.

Therefore, the deputies are already talking about canceling preferential taxation. Moreover, the people’s representatives do not plan to limit themselves to the gambling business. Most likely, the benefit will be removed for everyone, but at different times.

“We are waiting for the government’s position, but it says a lot that the benefit will be canceled from the middle of 2023,” said Danylo Hetmantsev, head of the Committee on Finance, Tax and Customs Policy.

First, the benefit will be canceled for the gambling business. The profile committee of the VRU has already supported the corresponding bill in the second reading. Therefore, in the case of prompt voting and signing, the law may enter into force by the end of 2022.

For the rest of the companies and FOP, the benefits will be phased out gradually. Deputies intend to develop a long transition period so that business has time to prepare. Although there is not much time left until mid-2023 to call the transition period “long”.
