Two bills with important changes to the Tax and Customs Codes are expected to be passed soon, which will finally settle two pressing issues: duty-free importation of Starlink, generators and other equipment, and storage of fuel without a license. People’s deputy from the “Voice” faction, Yaroslav Zheleznyak, who is part of the working group for the development of the document, announced this.
In Ukraine, as is well known, Starlink, generators and other equipment were exempted from VAT and customs duties due to the “covid” decree of the Cabinet of Ministers, with all the problems at customs. As already mentioned in the previous materials, in fact, the benefits apply not only to legal entities, but also to individuals, however, due to existing legislative conflicts (the resolution of the Cabinet of Ministers has insufficient legal force, if compared with laws), the customs office does not always meet the citizens. That is why amendments to the legislation, in particular to the Tax and Customs Codes, are being prepared. This will finally eliminate conflicts for citizens and businesses.
We are talking about draft laws #8196 and #8197 — both of these documents were supported by the parliament as a basis last week.
What exactly do they want to change?
- Exemption from VAT and duties directly on generators, batteries and Starlink, including for individuals, so that there are no more problems at customs. They will be allowed to be imported in any available way – even for international postal and express shipments. No additional requirements for certificates or other bureaucratic obstacles.
- The ability to store fuel for generators without a temporary martial law license is established only at the level of law. The government insists on storing up to 2,000 liters, and more than this limit will have to be reported to the tax office on a declarative basis.
According to Ukrainian legislation, a business, in particular coffee shops and co-working spaces, must have a license to store fuel for its own needs during martial law, otherwise it faces a fine of UAH 500,000. Ukrainians are only allowed to store fuel in consumer containers of up to 5 liters. The Chairman of the Tax Committee of the Verkhovna Rada, Danylo Hetmantsev, said the other day that there will be no fines for storing fuel without a license in the winter period for business entities in Ukraine. These are the same legislative changes that he announced the day before.

According to the plan, they will be transferred to the specialized committee of the Council on Monday, and during the next week they will be put to a vote. We hope that the changes will be made as soon as possible and Ukrainians will no longer have any problems with duty-free import of Starlink and generators or storage of fuel without a license within reasonable limits.
