To date, there are no documents that would confirm the legality of the presence of the Russian delegation in the UN.
Oleksandr Kovalenko, a military-political analyst of the “Information Resistance” group, explained why Russia’s membership in the UN Security Council as a permanent member with the right of veto is illegal.
“Legally, a country like the Russian Federation has never acquired the status of a member of the UN in accordance with the current Charter, procedural rules of the General Assembly and the UN Security Council,” the expert noted in his Telegram channel.
According to Kovalenko, to date, the Secretariat and the UN General Assembly have no documents that would confirm the legality of the presence of the Russian delegation in the UN.
“The only document is a letter signed by Yeltsin dated December 24, 1991 to the UN Secretary General. In the letter, Yeltsin asked to use the name “Russian Federation” instead of the name “Union of Soviet Socialist Republics”, although the formal renaming of the USSR to the Russian Federation took place only on January 29, which legally, it already creates a case precedent,” the expert continued.
Kovalenko emphasized that “the process of Russia’s expulsion from the UN is in full swing, and if this can be achieved, it will be a significant victory in the history of the organization, which has sheltered a moral destitute for three decades.”
Exclusion of Russia from the UN Security Council
At the end of December 2022, Ukraine initiated the process of excluding Russia from the UN Security Council and the United Nations in general. The Minister of Foreign Affairs of Ukraine, Dmytro Kuleba, emphasized that Russia is a usurper of the Soviet Union’s seat in the UN Security Council.
The Ministry of Foreign Affairs emphasized that the Russian Federation abuses the right of veto in the Security Council of the United Nations, which could lead to the destruction of the entire UN system.
At the same time, the Vice-Chancellor of the Ministry of Foreign Affairs of Estonia Märt Vollmer stated that the majority of states do not support Ukraine’s proposal to exclude the Russian Federation from the UN Security Council.
