Ukrainian business representatives believe that the “postal” law adopted by the People’s Deputies increased the pressure on business, created corruption risks, and some of its shortcomings could lead to market monopolization. This is stated by the company “Nova poshta”, whose representative has already addressed the relevant committee of the Council with comments so that the deputies improve the document.
It is noted that the law provides the right and opportunity to carry out international postal exchange for postal operators who have an operator code in the Universal Postal Union (UPU). Therefore, “Nova Poshta” turned to the BBC with a request to provide it with the appropriate code.
As the company said, they received an official answer that “since 2007, the Universal Postal Union has not issued such codes to postal operators who do not have the status of designated operator.” Therefore, NP cannot get a code, and therefore cannot enter the market of international shipments.
“Therefore, the Ukrainian market of international shipments will be divided between two operators that have a special code of the BBC – the state-owned “Ukrposhta” and the private service “Mist Express”, – the company noted.
At the same time, Novaya Poshta emphasizes, in the EU itself, the presence of such a code is optional since 2007.
“Therefore, the provisions of the Ukrainian law on postal communications contradict EU practice. And the deputies “drove” Ukrainians into a monopoly trap – people will simply have no choice. After all, without changes to the law that would bring it into line with European regulatory practice, access to the market of the rest of the operators is simply closed – it will become monopolized,” the NP is convinced.
“The above-mentioned circumstances fully testify to the actual and practical invalidity of the implementation mechanism of the idea laid down in the Law of Ukraine “On Postal Communications” regarding the need to prevent manifestations of monopolization on the market of postal services in the field of international postal exchange. Considering the above, we ask to initiate the development and implementation of urgent amendments to the Law of Ukraine “On Postal Communications”, which would allow postal operators to participate in international postal exchange under conditions of free competition with clearly established rules and requirements. conditions of participants”, – notes “Nova post office” in an official address to the chairman of the Parliamentary Committee on Transport and Infrastructure Yuriy Kisel – he is responsible for developing the legislative framework for regulating the post office of the post office.
Therefore, the NP company noted that the “postal” law has a number of shortcomings, so sooner or later the deputies will have to rewrite it, because Ukraine should harmonize its legislation with the European path to the EU.
Novaya Poshta says that even at the stage of work in the parliament on the bill, which will already regulate postal activities in Ukraine from December 2022, other serious comments were made about it. But the deputies ignored them.
