Today, October 6, Musk is due to testify again. Judge Kathleen McCormick suggests that the entrepreneur did not provide all the documents in the case, in particular, hiding part of the correspondence in the Signal messenger.
Musk and Twitter haven’t been able to agree on a deal for months. Offering to buy the company, Elon tried to cancel the deal, claiming that Twitter had lied about the number of bots on the platform. The company, in turn, sued Musk to force him to comply with the preliminary agreement – the date for the case was set for October 17.
Also last week, correspondence was made public that appeared in court documents. The messages were distinguished by the fact that they did not contain discussions of concerns about bots. Instead, Musk appears to have clashed with Twitter CEO Parag Agrawal, who asked Elon to stop posting negative tweets about the company.
Musk is a well-known supporter of Signal, a private messaging app that can automatically delete user messages. It turned out that its use can result in a problem – for example, when correspondence is needed for a lawsuit. Twitter also demanded that the judge “punish” Musk for the lost messages. On October 6, the entrepreneur must testify regarding this accusation.
In a letter yesterday, Judge Kathleen McCormick said she believes Musk did indeed use Signal.
“I am forced to conclude that it is likely that the responder allowed automatic deletion of Signal response messages and that those messages may have been irretrievably lost,” she writes.
McCormick has not yet decided whether she will impose sanctions on Musk, which Twitter has requested.
On October 4, Elon Musk filed a letter with the Securities and Exchange Commission in which he offered to buy Twitter for $44 billion (at $54.20 per share) — the same price he originally offered in April, indicating that he was in fact will complete the deal it originally agreed upon if Twitter drops the lawsuit.
