A California court has previously allowed workers to file a class-action lawsuit against Tesla alleging racism, with a hearing scheduled for October 2024.
As Bloomberg points out, the complaint was first filed in 2017 by Marcus Vaughn, who claimed that the Tesla factory in Fremont was a “hotbed of racist behavior.” The company allegedly “created a hostile and offensive work environment for black and/or African-Americans that includes the regular use of the words ‘N****r’ and ‘N***’ and other racially derogatory terms” and that the human resources department “ignored complaints” .
Tesla initially responded to the lawsuit with a blog post, calling it a “hotbed of misinformation.” The company denied wrongdoing and said it fired three people after an investigation into alleged racist incidents.
If the case does go to court (Tesla could appeal the decision until today), the process will be divided into two phases: during the first, a jury must decide whether the company did enough to prevent discrimination and harassment; and if so, at the second stage, the claimants (and there are about 6 thousand of them) will submit their claims for damages.
The Tesla factory in Fremont, California, also has a tumultuous history with worker injuries, with the injury rate there being higher than the US average. Musk himself is accused of opposing attempts by workers to unite in trade unions.
