Until now, the preservation of the average earnings of all workers called up for military service was guaranteed at the legislative level. However, on July 19, 2022, the Law Law of Ukraine “On the introduction of amendments to the current laws of Ukraine regarding the optimization of labor permits” No. 2352-IX , which provides for the introduction of important changes, in particular, in Part 3 of Art. 119 Labor Code of Ukraine. Provisions on maintaining average earnings at the place of work for employees during the period of conscription for military service are excluded from the article. Consequently, now only the place of work and position will be retained for such workers, but the preservation of average earnings is no longer guaranteed by the state – the above changes remove the obligation from employers to pay the average salary to employees called up for military service. In other words, now the decision to pay or not to pay the mobilized employees the average salary is made by the employer.
