The French publishing house Nacon on its official website published a statement in connection with the current situation around the psychological detective The Sinking City and the statements of the game developers – the studio Frogwares.
Recall that in early March, Frogwares accused Nacon of hacking The Sinking City and publishing its pirated version on Steam, after which it achieved the removal of the project from the Valve store using a DMCA complaint.
A French publisher called the studio’s accusations unfounded because Nacon “Under contract is the exclusive distributor of The Sinking City on Steam”.
Frogwares also refused to facilitate the return of The Sinking City to Valve’s service, which, under the terms of the deal, leaves Nacon the right to outsource the adaptation of the game to a third party.
Nacon, however, The Sinking City on Steam still returned and did not even begin to deprive Frogwares of legal payments that the studio could receive from the sale of a psychological detective on the site.
The publisher expressed regret over the conflict that had arisen (and especially Frogwares’ demand to remove The Sinking City from Steam), which they tried to avoid in every possible way.
In addition, Nacon did not hesitate to remind Frogwares about the investment in the game in the amount of € 10 million, as well as unsuccessful (due to the decisions of the Paris court) developers’ attempts to cancel the contract.
Nacon reserves the right to sue Frogwares for its “Aggressive and biased” statements, and also stated that all the decisions made in the case have so far been in favor of the publishing house.
The litigation between Frogwares and Nacon began in August 2020 and caused The Sinking City to periodically disappear from sale across platforms. Including a recent incident, the game has disappeared from Steam three times already.
