The Russian occupiers will be judged not only according to international law, they will also be held accountable for their atrocities in Ukraine. A special military tribunal may also be established for a specific crime.
Russian occupiers will be judged not only by international law, but also in Ukraine. The different strategies are not mutually exclusive. These are parallel processes.
This was announced at the conference on May 3 by the Prosecutor General of Ukraine Irina Venediktova.
“We are moving in different ways. Since the beginning of the war, I had a strategy on how we will go for justice. The first, of course, is the Ukrainian strategy. They do not exclude each other. These are parallel processes. The first is Ukrainian courts, the second is the courts of national jurisdictions , where cases are also open. We have another 14 countries opened their own cases on war crimes and related. Next, we take the International Criminal Court. Why is it important for us? Criminal responsibility is individualized there. That is, we will have a specific criminal who will be on the bench defendants,” she said.
Next, according to Venediktova, is the UN court.
“But the UN Court is what kind of story? State against the state. Then, of course, the Strasbourg (European Court of Human Rights). Yes, the Russian Federation withdrew, but I am very grateful to the partners from the Council of Europe, who extended another 6 months for Ukrainians, when we We can file lawsuits there. Considering justice, this is important. We all remember examples when some states left the Council of Europe and then returned,” the Prosecutor General said.
Also, another last option, which the Ukrainian authorities powerfully declare, is the creation of a special military tribunal for a specific crime. This is a crime of aggression.
“That is, if we are working on different ones: war crimes, crimes against humanity, genocide, a separate tribunal for the crime of aggression can still be created,” Venediktova summed up.
Earlier, Venediktova said when the tribunal for the Russian occupiers will start working.
