“Russian Armed Forces servicemen and their families consult with lawyers en masse about responsibility for refusing to participate in a special military operation on the territory of Ukraine. According to lawyers, a “special military operation” on the territory of Ukraine is not a war, therefore refusal to take part in it falls under Article 42 of the Criminal Code RF “Failure to execute an illegal order or order” and excludes criminal liability,” Tsymbalyuk informed.
He added that, on the contrary, commanders and chiefs who give illegal orders will be held criminally liable under the legislation of the Russian Federation.
Recall that in the Zaporizhia region, the invaders moved to the positions of the Armed Forces of Ukraine, but got “on the nuts” and were forced to run away. Moreover, the unharmed Russian soldiers were in such a hurry to leave the battlefield that they “forgot” the wounded and killed .
