Minister of Justice of Ukraine Denys Malyuska spoke about the prospects for international courts due to Russian aggression against Ukraine and announced the time frame when the war criminals of the Russian Federation will receive their first sentences.
He announced this on the air of the information marathon.
The head of the Ministry of Justice expressed confidence that Ukraine has enough evidence of war crimes of the Russian troops, the crime of aggression, and “under certain circumstances, it is also possible to ascertain the existence of a crime of genocide.”
“There are a lot of bodies, or courts, that will eventually pass sentences on war criminals, including military personnel and the top leadership of the Russian Federation. These are national courts, prosecutor’s offices, this is the International Criminal Court, which has jurisdiction over war crimes and genocide in Ukraine This is a tribunal that will be created for crimes of aggression, the creation of which was recently supported by the Council of Europe, as well as the courts of other states,” the minister said.
Maliuska said that the full launch of these mechanisms and the first sentences would be at least in a year and a half or two . “Of course, the full launch of these mechanisms and the first sentences will take at least a year and a half or two. Because, of course, international jurisdictions have always been slow, and these are still very fast terms for international courts, as a rule, it is six to eight years and longer,” he said.
According to him, the main problem is to bring the monsters to justice – to physically detain them .
“We have no doubt that there will be enough evidence that many Russian citizens or those fighting for Russia or in its interests can be sent to prison for very long periods, at least receive sentences. Here the problem is different, to send them to prison, they you need to be physically caught. If it is a Ukrainian court that passes a verdict, Interpol will be a tool to search for such people,” Maliuska said and added that when the verdicts are handed down by the International Criminal Court, its jurisdiction is supported by most countries of the world, and will not take into account diplomatic protection, for example, the immunity of Vladimir Putin and his entourage if they enter the territory of a country that recognizes the jurisdiction of the International Criminal Court.
“At least, we will limit their ability to leave the territory of the Russian Federation, and then sooner or later we will get them physically. If I were the Russians, I would not leave the territory of Russia, although this does not guarantee danger, the regimes are changing,” the minister noted.
He called the recovery of compensation from Russia for the damage caused by aggression the second block of bringing Russia to justice.
